We assist our clients in all litigation phases against the tax authorities. The international exchange of information has become a source of numerous administrative procedures and automated tax audits. Every year, Belgium automatically receives information from abroad concerning the assets held by Belgian taxpayers outside our borders.
Our firm has therefore developed a strong litigation practice.
Our approach is first to use amicable methods to settle tax audits. We believe that the conclusion of an agreement with the auditors best protects the interests of our clients by avoiding long and sometimes costly legal proceedings.
When we are unable to reach an agreement with the auditor in charge, we defend our clients’ position during all stages of the administrative procedure.
Our lawyers also initiate legal proceedings against the FPS Finance and regularly plead before the courts.
When the nature of the case allows it, we also propose to our clients to file a request for tax conciliation with the competent department.
In the case of foreign cases, when Belgium and another country consider that they are both entitled to tax the same income, we initiate an amicable procedure in order to settle the conflict of jurisdiction between countries.
