We set up and review our clients’ financing structures, taking into account the tax frictions applicable to the various external and intra-group financial flows. Our expertise covers both Belgian and international tax law issues, taking into account the application of European directives and double taxation agreements signed between states.
Many legislative initiatives have been approved in recent years at EU and OECD level to restrict the use of passive holding companies. We particularly draw our clients’ attention to the new international requirements.
Our lawyers have a thorough understanding of the deduction for definitively taxed income, the so-called “DTR regime”, in particular with regard to the questions concerning the minimum taxation requirements for dividends from foreign subsidiaries.
In the area of banking and finance, we handle various issues relating to the tax status of investment companies and mutual funds. We help our clients navigate the complex tax transparency regime for foreign investment vehicles.
